Question about Gambling websites with Curaçao license using incorrect Merchant Category code (side 1.598)

Send many and for months but still no refund so…

This may have been covered, but there’s an interesting issue around Kryptonim/Ivy/Augustus and vIBANs (virtual IBANs) being associated with customers’ names.

My bank originally rejected my APP claim as Me2Me, saying the receiving account was "held in your name and under your control." This came from openpayd and kryptonim

The issue is that a vIBAN can have your name attached to it without actually being an account you own or control.

The PSR specifically says an "account controlled by the consumer" means one the consumer can access and make payments from, and importantly: "It is not sufficient for it to be in the consumer’s name."

So if anyone has had a claim rejected as Me2Me because the receiving account appears in their name, it may be worth asking your bank to prove you could actually access the account and make payments FROM it.

I’m waiting on DSAR information which should hopefully clarify exactly what happened with mine.

I’m still trying to identify the actual merchants behind them as well. If your bank provides the MCC or Acquirer ID/ICA, please share it. I’ll do the same if I get anything more concrete on my side.

So far, the remaining cases are mostly just progressing through my bank. I haven’t received any meaningful response from Walleto directly regarding the chargebacks.

I’m keeping an eye on each case and responding if the bank asks for anything else. Since one has already been successful, I’m just going to let the chargeback process run its course for the others.

Yes, I’ve managed to recover some of the money through chargebacks, but not directly from Xpate or the merchants. A few cases were decided in my favour and the funds were returned.

I still have quite a few transactions pending though. Xpate challenged some of them, so those are taking longer. I’ll update the thread once I get more results.

Thanks, that’s interesting. I’ve seen Cardaq mentioned in relation to some similar descriptors as well, so I’m trying to work out whether there’s actually a common payment trail here.

I’m particularly interested in Hexo Land and SIS Art Union at the moment. If you manage to confirm Cardaq/CardServ for either of them from your bank data, please let me know. I’ll post anything I find on my side too.

Please keep us updated when Xpate sends the actual GDPR response. I’m especially interested to see whether they identify the merchants behind those descriptors or confirm which transactions were processed by them.

Yes, comparing the MCCs could be particularly interesting. I’m curious whether calcal and jusdot5 were presented in the same category or whether different MCCs were used despite both being connected to Xpate.

Let’s compare the details once we hear back from our banks. I’ll share the Acquirer ID/ICA and MCC if I manage to get them.

Thanks, that’s exactly the kind of confirmation I was looking for. If your bank identified Xpate from the transaction data, that’s much more useful than simply assuming it from the descriptor.

Please post the MCC and Acquirer ID/ICA when you get them. I’ll compare them with the information I receive for jusdot5 and jusski6 on my side.

For the cases that were resolved, it took several weeks after I challenged Xpate’s evidence before I received the final decision and the money was returned.

It wasn’t exactly the same for every transaction. In some cases I didn’t see anything further from Xpate after my response, while others continued for longer. My bank basically told me to wait while the dispute process ran its course.

I still have several pending, so I’m checking each case separately rather than expecting them all to be resolved at the same time.

I’m also trying to find out whether anyone has actually had a refund involving Visual Mill, XOR Visual Layer or Art Solution, not just identified the acquirer. If you come across someone who managed to recover the funds, let me know how they did it — directly, through the acquirer, or by chargeback.
